These Terms of Service explain and govern our relationship: what we can do for you, what you need to do. They provide the essential rules that govern the relationships between Smartists and its users, as well as the relationships between users when using Smartists for communications and exchange of value.
The Smartists experience is new. We have tried to explain these terms in simple words for you to read and understand them well. If you have any doubts, you can contact us and/or consult with a lawyer, before agreeing.
The Smartists services provide solutions for authors-artists in any field as well as art-users. Our services are Creator-focused, we highly respect the right to Privacy, and we put security first since our users are the owners of valuable assets, so Smartists is built on the Stacks blockchain, and secured by Bitcoin.

Our services are designed for authors to take control of the Intellectual Property of their digital art works on the Internet.
We provide you a personal identifier in the form of a private key - provided by Stacks Hiro Wallet - so you can open your Private Studio on the web, where you can showcase some pieces, share projects in progress, connect and exchange information with privacy. Moreover, we provide the technology for you to open your own Private Gallery where you can identify and authenticate your artworks as NFTs and sell them directly to your clients getting paid directly to your wallet.
Smartists Legal solutions are built for you to make business with legal support.
To be able to connect and exchange information privately, any Smartists' user needs to sign the Smartists Confidentiality Agreement (NDA). This makes any transfer of information within the app enforceably confidential.
To be able to sell or buy a digital art files as Genuine Art NFTs in a Private Gallery, all parts agree to the General Licensing Terms for Genuine NFTs’ sales. NFTs in the Smartists Private Galleries are genuine and come with a Copyrights License with specific Special Terms defined by the Genuine NFT creator and copyrights holder.
Smartists provides the technology but is not responsible of its use: once the key is provided, we cannot access any content, neither provide new access in case of loss of the private key. You must keep your keys safe yourself!
USERS RETAIN ALL THEIR COPYRIGHTS RELATED TO ANY CONTENT SHOWCASED OR FOR SALE IN THEIR PRIVATE STUDIOS AND GALLERIES.
Self-managed creators are solely responsible for the content they showcase, sell and license.
